James H. Maynard, Esq. is the founder and managing member of Maynard Law Office, LLC, a New Jersey law firm with a practice concentration in post-conviction sex offender legal representation, or what may be referred to as a “Megan’s Law” practice. 

Mr. Maynard’s practice has grown to include all Megan’s Law and Parole Supervision for Life (“CSL and PSL”) issues on a multi-statewide level.  Mr. Maynard’s experience ranges from the defense of individuals at the pre-conviction phase for charges like sexual assault, to post-conviction matters such as Failure to Register under Megan’s Law.  Mr. Maynard is experienced in the criminal trial court, the courts of appeal and in administrative agencies like the New Jersey State Parole Board.   Mr. Maynard’s case representation has led to multiple successful results before the New Jersey State Supreme Court on varying Megan’s Law issues.

As one of the pioneering forces in this area of the law, and with the experience of over 20 years as a criminal defense practitioner, Mr. Maynard advocates policies that are rational, objective and effective in reducing sexual abuse, such as a “Risk-Based” approach to sex offense law and policy.  He also believes that in order to be effective, sex offender registration and supervision schemes must use empirically validated and scientifically accurate factual data in an objective manner.  Mr. Maynard opposes the use of misinformation and the influence that social hysteria and politicization has had on the creation of the sex offense law in New Jersey and nationally.

Mr. Maynard has sought to promote unique solutions to problems faced by Megan’s Law registrants, such as: the continuing development of a procedure for international transfer of CSL and PSL, seeking post-conviction relief for advanced-aged sex offender registrants, and challenging the constitutionality of lifetime registration for juvenile offenders.

Mr. Maynard’s awareness of the inequities and disabilities that registered sex offenders experience motivated him to propose, form, and chair the Megan’s Law Sub-committee of the Criminal Section of the New Jersey State Bar Association.  The Megan’s Law Committee seeks to refine the sex offender laws in a manner that more appropriately balances the protection of the public with fairness to Megan’s Law registrants.  In addition, he has been appointed Executive Director of USA-FAIR, a national advocacy organization for the rational reform of sex offender laws.

Mr. Maynard is a dedicated, widely respected attorney within this field of law, who provides zealous and caring representation to all of his clients.  He seeks to bring about systemic change in sex offense law and policy that will result in more effective protection of the public, and that also provides a greater degree of fairness to persons with a sex offense history.
